摘要: 在反垄断司法实践中,传统领域对相关市场的界定主要从产品、地域2个维度展开,对时间因素的考量主要限于特殊情形,例如针对季节性特征强的产品、峰期与非峰期明显的产品等。在互联网领域,由于互联网市场结构的动态性、竞争的潜在性、网络效应的存在以及产品的知识产权特征、生命周期特征等,要求应将时间因素纳入互联网相关时间市场的界定之中。文章认为,互联网相关时间市场界定的具体方法可借鉴互联网产品的知识产权保护期与互联网产品的生命周期。

Abstract: In the judicial practice of antitrust, traditional domain gets definition of relevant market mainly from two dimensions of product, territory. The consideration of time factor is mainly limited to special circumstances, such as products with a great seasonal feature or have peak and off-peak hours, etc. In the field of the Internet, due to the existence of the dynamics of the Internet market structure, competition potential, network effect and product characters of intellectual property and life cycle characteristics, time factor should be considered when defining the relevant market in Internet. The paper thinks that the determination method of relevant time market in the internet can learn from the Internet product intellectual property protection period and the life cycle of Internet products.
