摘要: 作为一种战略性产业,航空产业的发展必须依靠政府支持,基于此,美欧政府都对各自的航空产业发展给予各种支持,由此也引发两者之间的一系列争端。目前,中国的大飞机项目正稳步推进,随着中国飞机制造能力的提高,来自欧美的补贴之诉将无可避免。文章基于民用航空器补贴的立法现状,结合美欧航空工业补贴实践,探讨《补贴与反补贴措施协议》对航空工业的适用性,并就中国大飞机项目如何避免和应对未来的补贴诉讼提出建议。

Abstract: Aviation industry is a strategic industry, therefore, US and EC have both provide various support for aviation industry, leading to a series of disputes between each other. Now, China's Large Commercial Aircraft Project is progressing steadily, with the enhancement of aircraft-producing strength of China, lawsuits against subsidy from US and EC are inevitable. This paper, based on the legislation of subsidies for civil aircraft and combined with practice of subsidies for aviation industry in the US and the EU, discusses the applicability of“Agreement on Subsidies and Countervailing Measures” and puts forward suggestions on how China's Large Commercial Aircraft Project to avoid and cope with the future lawsuits against subsidies.
