我国专利法框架下创新激励机制的构建

The Building of Innovation Icentive Mechanism under the Framework of the Patent Law in Our Country

摘要： 创新是经济发展、社会进步的根本动力.但创新需要激励,包括企业激励、市场激励、政府激励和产权激励.专利法框架下的创新激励机制属于产权激励,包括私人创新激励机制和社会创新激励机制.我国专利法框架下创新激励机制的构建面临的主要障碍是创新价值的背离和专利法自身缺陷所造成的对创新的阻碍.因此,我国专利创新激励机制的构建必须坚持创新价值、克服亲专利倾向,必须从我国实际出发、因地制宜.私人激励机制建立应以我国专利保护制度和职务发明制度改革为突破口,社会创新激励机制应注意提高专利质量、防范专利陷阱.

Abstract: Innovation is the fundamental driving force of economic and social development.But it needs a icentive, which comes from enterprise,goverment,market and property right.In patent law,the innovation icentive is a icentive of property right,which holds both personal and social icentive to innovation.They are the most important and stable. But in the building of icentive mechanism ,there are some obstruction coming from the going against the value of innovation and anti-innovation because of its nature endowment in patent law.Therefore we should hold in the value of innovation and consider the situation in china.In the improving of personal icentive mechanism to innovation ,the reformaton of protecting system of patent and the system of duty invention should take important role. And we should pay attention to improving of quailty of patent and prevention of patent traps in the building of social icentive mechanism to innovation.
